Terms of Service

1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the products, services, and digital content (“Services”) provided by AVGUST - FZCO, including products sold on behalf of other experts. By accessing or purchasing any Service, you agree to be legally bound by these Terms and our Privacy Policy.
If you do not agree, please refrain from using our Services.

2. Scope of Services
We offer a variety of Services, including but not limited to:
Online and mini-courses (live or recorded),
Private communities and membership clubs (subscription-based),
Digital products (PDFs, templates),
Individual consultations,
Free materials such as lead magnets.
Some Services are created and sold directly by AVGUST - FZCO. Others are offered in partnership with experts, but all payments, access, and client relations are managed by AVGUST - FZCO exclusively.

3. Eligibility
You must be at least 18 years old to access our Services. By using our Services, you confirm that you are legally capable of entering into a contract. If you register on behalf of a minor, you must be their legal guardian.

4. Payments, Subscriptions, and Early Access
Payments are processed via third-party providers (e.g., Stripe, Lavatop). You may purchase Services either:
As a one-time payment (e.g., for a course or digital file), or
On a subscription basis (e.g., recurring membership in a club).
Some products are offered for pre-sale. By purchasing in advance, you are reserving your spot. Access to content will begin on the official start date of the program, which will be communicated at the time of payment.
Early payment is considered a binding reservation and does not entitle you to a refund in case you change your mind before the program begins.

5. No Refund & No Chargebacks
Due to the nature of digital content, all purchases are final and non-refundable, including:
Missed live sessions or partial participation,
Change of personal circumstances,
Pre-purchase reservations.
By making a payment, you agree to contact us directly at help@avgust.ae for any questions and waive the right to initiate chargebacks or payment disputes through your bank or payment provider without prior written communication.

6. Access, Delivery & Completion
Access to content, communities, or services will be delivered according to the schedule outlined in the product description.
Accessing any part of the product (e.g., opening course materials, joining a group chat, attending a live session) constitutes full delivery of service and voids any claim of non-usage or incomplete delivery.
We reserve the right to modify, update, or replace any part of the program content, schedule, or delivery platform.

7. Intellectual Property and Use Restrictions
All materials provided (videos, PDFs, templates, call recordings, frameworks) are protected under intellectual property law.
You are strictly prohibited from:
Downloading or saving content unless explicitly allowed;
Sharing materials with third parties;
Using content for teaching, coaching, training, or reselling—even if modified;
Creating derivative works based on our materials.
Violations will result in immediate termination of access without refund and may lead to legal action.

8. Suspension and Termination
We reserve the right to suspend or terminate your access to any Service without refund if:
You breach these Terms,
You share content externally or engage in abuse,
You attempt chargeback without prior communication.

9. Expert Representation
In some cases, we sell products of third-party experts. However:
All purchases are made with AVGUST - FZCO as the vendor.
We act as the legal and financial intermediary and are responsible for content delivery.
Experts operate under contract and are not direct parties to the transaction.

10. Communication and Automation
By purchasing or registering, you agree to receive:
Onboarding messages and updates,
Automated reminders and follow-up emails or bot messages,
Access links, community invitations, and materials via email or messaging platforms (Instagram, WhatsApp, Telegram, etc.).
These communications are essential for service delivery and do not constitute marketing without your explicit opt-in.

11. Platform-Specific Terms
Some products may be hosted or distributed through platforms like:
Telegram bots and channels,
WhatsApp,
Notion,
Private websites or CRM-integrated tools.
You agree to abide by the usage terms of those platforms in addition to these Terms.

12. Results and Liability Disclaimer
We make no guarantees regarding your results. You understand that:
Success depends on your own effort, participation, and context.
We are not liable for financial or reputational losses.
We are not responsible for third-party service failures (e.g., platform outages, bot errors).
All Services are provided “as is” without warranties.

13. Team and Representatives
You may interact with our team members, curators, consultants, or bot managers acting on behalf of AVGUST - FZCO. Their actions are governed by our internal protocols and do not imply direct representation by Alisa Avgust personally.

14. Force Majeure
We are not liable for failure to perform due to unforeseen events beyond our control, including technical outages, illness, war, acts of nature, or legal restrictions.

15. Limitation of Liability
To the fullest extent permitted by law:
AVGUST - FZCO is not liable for any indirect, incidental, or consequential damages;
Our total liability under any claim is limited to the amount you paid for the Service in question.

16. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Arab Emirates. You agree to submit to the exclusive jurisdiction of the courts of Dubai.
Class actions and collective claims are strictly prohibited.

17. Modifications
We may revise these Terms at any time. The latest version will always reflect the “Effective Date” above. Continued use of our Services indicates your acceptance of any updates.
